The NDC and the Law on Perjury

It all begun from its roots, its origin. Rawlings who had killed military personnel in 1979, for overthrowing constitutional governments in 1966 and 1972, swearing on oath, to all Ghanaians, that never again should this be tolerated, came back in two and a half years, to overthrow a constitutional government.

He lied to Ghanaians and so committed perjury. Yet no one took Rawlings to court for perjury.

Fast forward to 1996 and Rawlings was going for re-election with a new running mate. He was the quiet, humble looking professor of law, Prof. John Evans Atta Mills. As a running mate he was to file his papers and at the Column: Number Of Children, he ticked NIL.

It was then that the ever truthful and vibrant, Ghanaian Chronicle, the Voice of the Nation, remembered that one fine day, a certain Ruby Addo, who was student of the renown Professor, had delivered a bouncing baby boy for John Evans Atta Mills.

According to the Chronicle, due to both the fear and respect the lawman had for his legally married wife, he performed the outdooring and naming ceremony of the boy-child in a friend’s house. But fast-forward to 1996, how can the Professor forget he had a son? This was perjury.

But guess what, it was the era of an NDC regime and the NDC clearly displayed to Ghanaians that in its books and with its lawyers of good legal standing, perjury cannot be found. So, John Evans Atta Mills sailed through to become the second vice president of the republic, even after committing perjury and NDC will not sue him.

In December 2008, the NPP parliamentary candidate for Bawku Central, won the seat with 55.44% of the total votes cast.On July 31, 2009, he was charged with nine counts of perjury, forgery of passport, election fraud, false declaration of office and deceit of public officer before the High Court, after an NDC cattle dealer from Bawku, Sumaila Bielbiel, challenged his status as MP for Bawku Central in a civil suit.

On Friday July 27, 2012, the late MP for Bawku Central, Adamu Dramani Sakande, was sentenced to two years in prison by a High Court after being found guilty of false declaration of office, perjury and deceiving a public officer.

It then became obvious that at long last the NDC had come to realise that there was a crime called perjury.

Adamu Sakande had gone to file his papers, stating that he was not a dual or multiple-citizen, when he was. FULL STOP, HERE!

In 2012 and 2016, a certain Canadian-Ghanaian, attempted twice to be on the ticket of the NDC as parliamentary candidate of Assin North, but twice the Central Regional Executives of the NDC rejected him.

Still, holding dual-citizenship he made a third attempt in 2020. The region dismissed him again, but the National Head Office of the NDC, endorsed him to present himself as parliamentary candidate which he did. This gentleman, James Gyekye Quayson, filed to contest the seat, stating, as Adamu Sakande did, that he was not a dual or multiple-citizen, when he knew he was. FULL STOP, HERE!

Will his perjury case be heard, if the NDC had won the 2020 Elections? Ghanaians will doubt. If Woyome could be literally set free of criminal charges, by the NDC government, after stealing money belonging to Ghanaians then nothing could go past it.

James Gyakye Quayson was thrown out of Parliament but was illegible to contest this time, since he had renounced his Canadian citizenship, notwithstanding the perjury case against him in court. He contested and won and he is back in court to explain why punitive measures should not be taken against him for the perjury he committed in October 2020.

Today the NDC is fully behind Mr Quayson in court and doing its best to convince Ghanaians that the MP had committed no offence.

The NDC party which was screaming all about the that it was unconstitutional to deny two constituencies, Guan and Assin North, off MPs, who need to be in Parliament to do business for the constituents, is today denying one-hundred and thirty-seven constituencies of their MPs, since all NDC MPs have boycotted Parliament to be in solidarity with Gyakye Quayson who is facing criminal charges in court.

And what is all this noise about the NDC challenging the proposed daily court proceedings, as if it will serve injustice? Twice in 2013 and 2021, Ghana witnessed daily proceedings in court on election petitions. If during those times, justice was served, why could it be different in this case?

Today the NDC is telling Ghanaians that perjury is not a crime and yet, it is in the 1992 Constitution drafted by a majority PNDC appointees who formed the Consultative Assembly.

Meanwhile, the leader of the Opposition, Ato Forson who is also in court for criminal charges, and he too, is also fully backed by the NDC who has decided that it is wrong to punish someone for economic crimes. It is not surprising, since Woyome was let loose after stealing our tens of millions of dollars.

The NDC does not see perjury when it is committed by its members. It wants to live by the law but at the same time, it wants the rest of Ghanaians to die by the same law.

No files implicating Tinubu in our custody, ICPC clarifies

The Independent Corrupt Practices and Other Related Offences Commission, (ICPC) has refuted claims that it has files implicating President Bola Ahmed Tinubu or his close aides at its headquarters or offices across the states of the federation, in its custody.

A report emerged (Not Channels Television) that the Department of State Services (DSS) is removing all incriminating files from the Code of Conduct Bureau (CCB) and ICPC relating to Tinubu and his close aides and associates.

Tinubu was arraigned before the Code of Conduct Tribunal in September 2011 for allegedly operating foreign bank accounts, contrary to the constitution.

However, in a statement on Saturday, ICPC spokesperson, Azuka Ogugua, described the report as fake.

She said the attention of the commission was drawn to a spurious news report by an online medium, titled “Secret Police, DSS Carts Away Files Implicating President Tinubu, Close Aides from ICPC, CCB”

The commission stated that it was deeply disturbed by irresponsible practice and non-adherence to the tenets of the journalism profession by some media outlets.

The anti graft agency also urged media organisations not to allow the use of their medium to propagate lies and unfounded reports by subversive agents as the commission’s channels of communications remained open for clarification and confirmation, the statement added.

“The commission hereby states unequivocally that there were no files implicating President Bola Tinubu or his close aides at its headquarters or offices across the states.

“And, therefore, the alleged carting away of such imaginary files is unfounded and should be disregarded by the public,” Ms Ogugua stated.

Otedola loses top shareholder spot at FBN Holdings

Femi Otedola, the chairman of Geregu Power, has yielded the top spot on the ownership ladder of FBN Holdings to Barbican Capital Limited, an affiliate of Oba Otudeko’s Honeywell Flour Mill, a regulatory filing showed on Saturday.

Barbican Capital accumulated shares of about 4.8 billion units in the parent company of Nigeria’s oldest lender FirstBank translating to a 13.3 per cent holding in the corporation, according to the document seen by PREMIUM TIMES.

That is more than twice the portion held by Mr Otedola, who in late 2021 had acquired a 7.6 per cent interest in the financial services group via off-market deals.

He displaced FirstBank’s Chair Tunde-Hassan Odukale to take the lead position but now holds a 5.6 per cent stake, having sold 834 million shares last June after the valuation of the stock soared.

Mr Otudeko, who chaired the group’s board until a shake-up ended his tenure in April 2021, controls Honeywell Flour Mill, where he owns a 75 per cent stake through Siloam Global Services Limited, according to the company’s 2022 earnings report.

Trading in the shares of FBN Holdings has been brisk this week, with almost 5 billion units traded, 95 per cent of that transacted on Thursday alone

The buy pressure and the current currency revamp in Africa’s largest economy have catapulted the stock’s valuation to its peak level ever, with its market capitalisation now at N728.7 billion, making Nigeria’s fourth-biggest lender by market value.

Only Zenith Bank, Guaranty Trust Holding Company and Stanbic IBTC Holdings Company exceed the group valuation.

In late April, Mr Otedola gave up the scramble for the top ownership of Nigeria’s biggest listed conglomerate Transnational Corporation of Nigeria to billionaire investor, Tony Elumelu, after clinging briefly to the second spot on the ownership hierarchy.

3 senior police officers dismissed over misconduct

The Police Service Commission said it has approved the dismissal of three senior Police officers over cases of misconduct and abuse of office.

Ikechukwu Ani, Head, Press and Public Relations, in a statement on Sunday said nine other officers were reduced in ranks including a Commissioner of Police, adding that the commission took the decisions at the continuation of its 21st Plenary Meeting which began at its Corporate Headquarters in Jabi, Abuja on Thursday.

Thhe statement said the meeting was presided over by Justice Clara Bata Ogunbiyi, retired Justice of the Supreme Court and Commissioner representing the Judiciary in the Commission who stood in for Commission’s Chairman, Dr. Solomon Arase CFR, retired Inspector General of Police.

While commending the members for the disciplinary action, Dr. Arase said the decision was in line with his promise not to do anything that will impede the career progression of any officer.

The meeting also approved the compulsory retirement of an Assistant Commissioner and directed a refund of all entitlements wrongly paid to him. It also approved the posthumous promotion of late Inspector Ifeanyi Oroke to the next rank of ASP 11 for acts of gallantry.

The meeting reinstated one dismissed Inspector Augustina Oko, effective from the date she was dismissed and approved the punishment of severe reprimand on 16 officers and reprimand for another 18.

It directed that letters of warning be given to two other officers.

“The Commission had earlier approved the appeal for adjustment of the date of promotion to the rank of Assistant Commissioner of Police of ACP Woke Iheanyi Kingsley and reinstatement of CSP Anaele Samuel Onuoha in compliance with a ourt judgment,” the statement said

Court orders Nigerian govt to account for $5 billion Abacha loot

The Federal High Court in Abuja, in a landmark judgment, has ordered the disclosure of the spending details of about $5 billion Abacha loot by the governments of former presidents Olusegun Obasanjo, Umaru Yar’Adua, Goodluck Jonathan and Muhammadu Buhari.

 

The court ordered the government of President Bola Tinubu to “disclose the exact amount of money stolen by General Sani Abacha from Nigeria, and the total amount of Abacha loot recovered and all agreements signed on same by the governments of former presidents Obasanjo, Yar’Adua, Jonathan and Buhari.”

 

The judgment was delivered last week by Justice James Omotosho following a Freedom of Information suit number: FHC/ABJ/CS/407/2020, brought by the Socio-Economic Rights and Accountability Project (SERAP).

 

In his judgment, Justice Omotosho held that “In the final analysis, the application by SERAP is meritorious and the Federal Government through the Ministry of Finance is hereby ordered to furnish SERAP with the full spending details of about $5 billion Abacha loot within 7 days of this judgment.”

 

Justice Omotosho ordered the government to “disclose details of the projects executed with the Abacha loot, locations of any such projects and the names of companies and contractors that carried or carrying out the projects since the return of democracy in 1999 till date.”

 

Justice Omotosho also stated that “The excuse by the Minister of Finance is that the Ministry has searched its records and the details of the exact public funds stolen by Abacha and how the funds have been spent are not held by the Ministry. The excuse has no leg to stand in view of section 7 of the Freedom of Information Act.”

 

Justice Omotosho dismissed all the objections raised by the Federal Government and upheld SERAP’s arguments. Consequently, the court entered judgment in favour of SERAP against the Federal Government.

Ghanaian rapper, Yaw Tog, recently announced his decision to temporarily suspend his education in order to fully concentrate on his music career. During an interview with Hello FM based in Kumasi, Yaw Tog explained that he believes he can achieve greater financial success through his music than he would with a university degree.

“University won’t provide me with the means to sustain myself in life,” stated Tog confidently. “I have strategized my life in a way that I will make money before pursuing a university education. If I enroll now, who will bear the burden of my tuition fees?”

Tog’s choice is not an isolated one, as an increasing number of young musicians have been opting to prioritize their careers over pursuing a university degree in recent years. This trend can be attributed to several factors.

Firstly, the music industry has become exceptionally profitable, particularly with the advent of streaming services. Musicians now have the opportunity to reach a global audience and generate substantial income from their craft.

Only time will tell whether Yaw Tog’s decision to pause his education will yield the desired outcomes

Hajia4Reall denied bail in the US

Ghanaian socialite and musician Mona Faiz Montrage, widely known as Hajia4Real, has been denied bail by a US court. This development has put her plans to return to Ghana in July in limbo.

Hajia4Reall is facing a series of charges in the US, including conspiracy to commit wire fraud, wire fraud, money laundering conspiracy, money laundering, conspiracy to receive stolen money, and receipt of stolen money.

The charges stem from her alleged involvement in a $2 million romance scam.

According to court documents, the Ghanaian socialite and musician is accused of using fake online profiles to pose as a wealthy woman and convince men to send her money. She is also accused of laundering the money she received through the scam.

Hajia4Real had requested the court to relax her bail conditions and allow her to move around certain areas while under house arrest. However, the court denied her request, citing the seriousness of the charges against her and the risk of her fleeing the country.

This is a major setback for Hajia4Reall, who had hoped to return to Ghana to be with her family and friends. It is unclear when she will be able to return to Ghana, as her legal proceedings are ongoing.

Elton John ends farewell tour after 52yrs of spectacular career

Elton John told his millions of fans on Saturday night that they would remain in his “head, heart and soul”, concluding his marathon farewell tour in Stockholm with one of his biggest hits – Goodbye Yellow Brick Road.

The 76-year-old singer has won five Grammy awards in a spectacular career spanning 50 years and nearly 4,600 performances worldwide.

“It’s been my lifeblood to play for you guys, and you’ve been absolutely magnificent,” he told the audience at Sweden’s Tele2 Arena.

Elton John paid an emotional tribute to his current band and crew, some of whom have been touring with him for many years.

“They’re really incredible,” he said, “and they are the best, I tell you, the best.”

He kicked off his show with Bennie and the Jets, and went on to perform many other hits, including Philadelphia Freedom, Tiny Dancer, Rocket Man and Candle in the Wind.

His Farewell Yellow Brick Road tour began in North America in 2018, and this was his second night performing in Stockholm.

The tour spanned the globe – he played to more than six million fans, and one of the highlights was his headline slot at the Glastonbury Festival last month.

That concert drew one of the biggest crowds in the festival’s history and a British TV audience of millions.

His gig in Stockholm included a video message from Coldplay, who were performing in the Swedish city of Gothenburg at the same time.

The band’s Chris Martin told Elton: “From all the bands and artists you’ve helped and inspired, we love you so much.

“We are so grateful for everything you’ve done for the Aids Foundation, anytime you’ve been kind to anybody,” he said.

It is one of the highest-grossing concert tours ever: Billboard magazine reports that it is the first to reach ticket sales of $900m (£701m).

Elton reflected on his life towards the end of this grand finale, telling the audience about his “52 years of pure joy playing music”.

He confirmed he would “never be touring again”, but he may do a “one-off thing” in future.

He dedicated his song Don’t Let The Sun Go Down On Me to his band, crew and family. The concert lasted more than two hours.

Sudan conflict: Air strike kills at least 22 in Khartoum

A Sudanese army air strike on the capital has killed at least 22 people and injured many others, eyewitnesses and an official have said.

Women and children were among the victims, the eyewitnesses told the BBC.

The airstrike hit the Dar es Salaam district of Omdurman, on the opposite bank of the Nile to the capital Khartoum, early on Saturday.

The army and a paramilitary force have been battling for control of the capital since April.

The conflict began after the head of the army, Gen Abdel Fattah al-Burhan, and the head of the Rapid Support Forces (RSF), Gen Mohamed Hamdan Dagalo, fell out over the future of the country.

A Khartoum state health official, quoted by Reuters news agency, said at least 22 people had been killed in Saturday’s airstrike, while the RSF said the death toll was 31.

The paramilitary group added in a statement that the strike had “caused significant destruction to homes”.

The UN secretary-general Antonio Guterres said he was “appalled” by the violence and concerned that the conflict would become full-scale civil war, “potentially destabilising the entire region”. He called on both sides to cease fighting and protect civilians.

The RSF controls much of Khartoum and its twin cities of Omdurman and Bahri. The army has carried out frequent artillery and air attacks to try and dislodge the paramilitary fighters. But it is thought that Saturday’s strike could have resulted in one of the largest death tolls from a single attack.
