Parliament in a fix over ‘who is present’ in the House

On Wednesday, July 19, 2023 Parliament could not commence business in the house due to a lack of quorum, as it had 91 members present, however, minutes of the proceedings recorded 201 members present.

The Second Deputy Speaker, Andrews Asiamah Amoako, who was in charge, was compelled to adjourn after he confirmed that there were 35 members in the chamber and a total of 91 MPs had signed the attendance.

“91” is still not even one-third. Honorable Members, I will go ahead and adjourn the House,” he said, subsequently bringing proceedings to a close.

However, during the correction of the minutes for Wednesday, which was done on Thursday, July 20, 2023 it was established  that the House that lacked quorum to do business for lack of numbers the previous day, had 201 members marked present, far above the minimum threshold for Article 102.

Article 102 of the 1992 constitution states “A quorum of Parliament, apart from the person presiding, shall be one-third of all the members of Parliament.”

EXPLAIN TO GHANAIANS

The First Deputy Speaker of Parliament, Joseph Osei Owusu, who was presiding yesterday, was astonished, as well as other members of the house, looking at the numbers marked present as opposed to the reason for adjourning the House.

He blamed the confusion on the lack of clear-cut definition of when a member could be counted as present.

“I think that we should be clear in our definition of when a member can be said to be present. Of course, when it comes to taking a decision, you may defer every matter and come into the Chamber, but when it is question time and I have a committee meeting, should I sit here and listen to Constituency-specific questions or go to committee sittings? These are matters that I think we should reconsider when we want to raise the issue of quorum.”

He agreed with the MP for Adansi/Asokwa, Kobina Tahir Hammond, who had argued that if care was not taken, parliamentary business, apart from those in the Chamber, would suffer.

“For the time being, I take note that it is on record that yesterday, 201 members were present. How that happened when Parliament truncated business because we did not have a quorum to transact business is a matter for which we may have to answer to the public,” the Deputy Speaker opined.

ORDERS

Order 7 states that, in these Orders, unless the context otherwise requires, “Committee” means a Committee of the Whole, a Standing, Select, Special, or Adhoc Committee; “Precincts of the House or Parliament” means and includes the Chamber, the Lobbies, the Galleries and grounds of Parliament House and such other places as the Speaker may from time to time specify. “Sitting” includes a period during which Parliament is sitting continuously without adjournment and a period during which it is in Committee.

COMMITTEE

The Member for Okaikoi Central, Patrick Yaw Boamah, who raised the issue, argued that several committees were sitting on that Wednesday, including the Public Accounts Committee, of which the South Dayi Legislator, Rocksn-Nelson Defeamapkor, who raised the issue of quorum, is a member.

He read from the order paper for that Tuesday, July 18, 2023 which showed members of the various Committee sittings for the following day.

He mentioned the Committees on Finance, Gender and Children, Youth, Sports and Culture, Subsidiary Legislation, Local Government, Employment and Communications.

He argued that each Committee is made up of about 25 members, but did not state whether all the Committees that sat had full attendance.

However, he stated that per the definition the Speaker had put on the member being present, meaning within the precinct of parliament, the quorum raised sent the wrong signal about the House to the public.

The Minority maintained their stance on the quorum, drawing strength from Justice Abdulai Versus the Attorney General case, repeated yesterday by the South Dayi MP, Rockson-Nelson Defeamakpor.

The MP disagreed with the Okaikoi Central MP but insisted that he was ensuring that the House respect the constitution and the interpretation by the Supreme Court.

The Minority Chief Whip, Ahmed Ibrahim, indicated that the House could not be ruling differently each day, adding that there “must be precedence.”

He said that the Minority was only being “lawful,” adding that if the majority “wants to litigate, check your back.”

The minority has said that it would adopt several strategies to ‘fight’ what it describes as “persecution” of the Assin North MP, James Gyakye Quayson, but what is not known is whether raising the issue of quorum is one of their strategies.

Another uneasy calm is hanging over the Bombay Wood Market, Akwatia Line, in Kumasi, with two people injured and traumatised.

It is the venue where gunshots were heard over a land dispute between two factions barely three months ago.

The latest was triggered on the mid-morning of Tuesday, July 18, 2023, when people believed to be land guards stormed the disputed land.

Information indicates that they allegedly attempted to supervise development on the land by Alhaji and Madina Construction, a private construction company owned by one Alhaji Aliu Salis.

Numbering about ten, the supposed land guards allegedly attacked and inflicted machete wounds on two male wood sellers, resulting in one sustaining lacerations on the mouth and gum.

The two injured people were admitted at the Manhyia Government Hospital receiving treatment at the time of this report.

Armed police officers from the Ashanti Regional Police Command, who arrived at the scene, could not make any arrests.

The Chronicle gathered that the disputed land, which has been an enclave for wood businesses over the last four decades, belongs to the defunct railway company.

Further information available to this paper has it that, there has been a bone of contention in the last three months, after the Asokore Mampong Municipal Assembly authorised  Alhaji and Madina Construction Company to go on with a project.

Speaking on a Kumasi-based radio station, one Mohammed Mahmud claimed that Ghana Railways had leased the disputed land to him.

Mahmud added that, the Municipal Assembly and Alhaji Salis tried all means to persuade him to kowtow to their demand to allow the contractor take over the land that had been leased to him (Alhaji).

He argued that, he was asked by the Municipal Assembly to sign a Memorandum of Understanding (MoU) between himself and Alhaji and Madina Contraction Company, an offer he rejected, and not long after, the contractor started developing the land, a move that compelled him to secure an injunction at the Asokwa District Court.

The law suit, according to him, could not come on, as the right procedure was not followed while filing.

As instructed by the court, the suit was re-filed, following the right procedure being followed, and an injunction was secured and placed on the project, yet the construction company still went on developing the land under the supervision of supposed land guards against the court orders.

This development, Mahmud stated, resulted in the incident that sent the two wood sellers to the hospital.

Responding to the allegations in a telephone conversation with The Chronicle, the Municipal Chief Executive (MCE) for Asokore Mampong, Mr. Kennedy Kankam, denied all the claims, saying the Assembly was not responsible for the mayhem that occurred at the Akwatia Line, Bombay Wood Market.

According to him, the Assembly only detailed its taskforce to supervise the project on the said land which belonged to the state, hence, the need to protect it.

Mr. Kankam, who is the former Member of Parliament for Nhyiaeso Constituency, argued that what happened at the Wood Market was not a fight, saying: “it was an individual who wanted to forcefully take over a state land, and the state decided to protect it.”

He told this paper that, while the land development was underway, Mohammed Mahmud pleaded with him to be given a portion of it on sale, an appeal that was turned down, because, according to the MCE, he did not have the power to do that, but rather directed him to the appropriate authorities with his request, after various attempts by Mahmud to have the said land sold to him.

The project, according to Mr. Kennedy Kankam, was paramount to him and all and sundry would benefit from it when completed, adding that it contained 400 shops, with lorry stations.

When contacted, the contractor, Alhaji Aliu Salis, directed this reporter to talk to the MCE of Asokore Mampong for further information.

Al-Ettifaq agree £12m deal for Liverpool’s Henderson

Liverpool have agreed a deal in principle worth £12m plus add-ons to sell captain Jordan Henderson to Saudi Arabian club Al-Ettifaq.

Henderson travelled to Germany with Liverpool for their training camp but was not involved in their 4-2 friendly win over Karlsruher.

The England midfielder, 33, has two years left on his contract at Anfield.

Former Liverpool captain Steven Gerrard was recently appointed as manager of Al-Ettifaq.

The agreement for Henderson follows Liverpool receiving a £40m offer from Al-Ittihad for fellow midfielder Fabinho last Friday.

Unlike Henderson, the 29-year-old Brazil international did not travel to Germany while his future is resolved.

A number of high-profile players have moved to Saudi Arabia this summer, including former Real Madrid striker Karim Benzema and ex-Chelsea midfielder N’Golo Kante.

Former Liverpool forward Roberto Firmino joined Al-Ahli after his Anfield contract expired, and Manchester City winger Riyad Mahrez has also been linked with the club.

Henderson joined Liverpool from Sunderland in a deal worth £20m in June 2011.

Henderson made 43 appearances for the Reds last season as they endured a disappointing campaign, finishing fifth in the Premier League and missing out on a place in the Champions League.

Overall, he has played 492 times for the Reds, scoring 33 goals and registering 57 assists.

Henderson was captain when Liverpool won the Champions League in 2019 before going on to win the Uefa Super Cup and Fifa Club World Cup later that year.

Onana jets out to meet Man United team-mates on pre-season tour in New York

Andre Onana was seen heading to New York on Thursday after carrying out his Manchester United medical, with the £43million goalkeeper set to link up with his new team-mates on their pre-season tour.

United are poised to confirm the signing of Onana, 27, from Inter Milan on a five-year contract with the option of a further 12 months after identifying him as their top target to replace David de Gea this summer.

De Gea called time on his 12-year spell at Old Trafford earlier this month after failing to agree a new deal – prompted by the reservations of manager Erik ten Hag over his suitability as the club prepare to challenge for major silverware.

Ten Hag and Co pinpointed Onana as their preferred candidate to succeed him in between the sticks, and after striking an initial £43m deal with Inter the shot-stopper was seen arriving in Manchester for his medical on Tuesday.

Two days later, the Cameroonian has been spotted at Manchester airport after seemingly completing that medical, allowing him to jet out to New York and link up with the squad ahead of official confirmation of his move.

If announced in time, Onana could make his debut against Arsenal on Saturday in New Jersey before featuring in subsequent matches against Real Madrid and Borussia Dortmund.

Neymar has revealed he will stay at Paris Saint-Germain despite fans demanding him to depart last season.

The Brazilian star remains the most expensive player in history after joining the French side from Barcelona for £190million in 2017.

However, doubts have remained over his future at the club after they failed to deliver the Champions League once again.

Fans displayed their frustration in May as they gathered outside Neymar’s house to demand him to leave but he hopes to remain with the club for the upcoming season.

‘I hope to play this season at PSG, I have a contract with Paris. So far, no one has told me anything,’ the 31-year-old stated in an interview with CazeTV.

‘I am calm, even if there is not much love between the supporters and the player. I will be there with or without love.’

Neymar’s campaign last season was ended by an ankle injury suffered in February and required surgery having suffered a similar problem at the Qatar World Cup three months earlier.

He returned to training last week and is looking to get back on the pitch once again after overcoming a ‘difficult’ process.

Neymar said: ‘The process was very painful and it is very difficult, but I am trying to come back well. Obviously, winning is always part of the objectives, but I want to play well again, that’s the first thing.’

He added on the pain of being eliminated by Croatia at the 2022 World Cup: ‘I can’t tell you what went through my head. It was the most painful defeat of my career, for sure. I cried for five straight days. It hurt me a lot that my dream had turned to nothing”.

Ronaldo risks Nike contract breach after wearing Adidas shin pads

Cristiano Ronaldo has risked a breach of contract with Nike after appearing to wear Adidas shin pads.

The 38-year-old marked his first pre-season appearance as Al Nassr wear thumped 5-0 by LaLiga side Celta Vigo on Monday.

Ronaldo played the first 45 minutes and watched the second half, where all five goals were scored, from the stands.

However, the Portuguese star produced controversy as football kits experts Footy Headlines spotted him wearing the Adidas X Pro shin pads while under contract with their rivals Nike.

Ronaldo has been contracted to Nike since the early stages of his career in 2003 and is on a £147million, 10-year deal with the American giants.

He is one of Nike’s biggest athletes and has appeared in multiple TV adverts promoting the brand’s boots.

Ronaldo’s usually sports personalised shin pads, having  appeared to have a picture of his face next to the crest of the Portugal national team during his second spell with Manchester United.

Meanwhile, Ronaldo’s Al Nassr announced earlier this month that Nike will be their new kit manufacturer.

Bawumia speaks: My Hands Are Clean! …I’ve not received campaign cash from any Islamic group in Nigeria

The Communication Directorate of the Bawumia Campaign Team has debunked allegations that it receives funding from an Islamic group in Nigeria.

The Communication Directorate has also refuted allegations that the campaign team has had some dealings with the said Islamic group, named Arewa Consultative Forum (ACF).

“For the avoidance of doubt, the Bawumia Campaign has no funding or any linkage with any Islamic group in Nigeria, or anywhere else,” the campaign team has said.

A statement issued on Wednesday, July 19, 2023 from the camp of the aspiring flagbearer of the New Patriotic Party (NPP), Dr. Bawumia, said the “narrative is obviously false.”

According to the statement, the Nigerian journalist, David Hundeyin, who made the allegation, had demonstrated a taste for making such claims against persons and groups in Nigeria, without basis.

Meanwhile, the release remarked that the Bawumia Campaign is focused and will not be distracted by such vain untruths.

The maker of the allegation was commenting on a Twitter post that encouraged Nigerians to invest in their media to be able to project the Nigerian, as they could tell the story better than anyone else.

In a series of responses, David Hundeyin also alleged that “think tanks and lobby groups spend millions of dollars annually on local and foreign political astroturfing on a scale you cannot begin to comprehend. For example, the ACF is funding a Muslim candidate (Mahamudu Bawumia) in Ghana’s 2024 election. You already know why.”

THE GROUP

The Arewa Consultative Forum is a political and cultural association of leaders in Northern Nigeria formed in 2000 that has considerable influence on the political scene. The forum is a successor to the Northern People’s Congress, which collapsed after the coup of 1966.

Meanwhile, Dr. Bawumia is on his nationwide campaign to convince delegates to vote for him at the Super Delegates’ Congress set for August 26, 2023 and subsequently at the main Congress on November 4, 2023.

Alan Cash promises to empower 2 local road contractors per constituency

A flagbearer aspirant of the New Patriotic Party (NPP), Mr. Alan Kwadwo Kyerematen, has assured supporters of the party that under his tenure as president, two local contractors in every constituency would be empowered to execute local contacts instead of relying on expatriate construction firms all the time.

Speaking at Buem as part of his campaign tour of the Oti Region yesterday, Alan Kyerematen, also known as Alan Cash, said the idea behind his plans was to support the local economy, since the money paid to these contractors would, in most cases, remain in the constituency.

The former Trade and Industry Minister reiterated his desire to pay all constituency executives of the party when he is elected to lead the party.  He, therefore, called on the delegates to choose a leader who would resonates with the people they were representing in their various electoral areas and polling stations.

He also urged the delegates to woo floating voters, as they played important and influential roles in determining the fortunes of the party at the national level. Alan Cash insisted that he was the best and only candidate, out of the 10 contestants, who can garner the votes needed to break the 8 in 2024.

He emphasised that since the primary was an internal party contest, it was important that all aspirants played the game fairly and refrained from insults and name-calling that could affect the fortunes of the party in future.

Kyerematen said he possessed the qualities to unite the party to work hard for victory in the national elections in 2024, and urged the delegates to vote for him.

The aspirant is expected to meet delegates from all constituencies on a zonal basis to end his tour of the Oti Region today.

$2m payment for Sky Train project was made by GIIF not Railways Ministry -Ghartey

The former Minister of Railways Development, Joe Ghartey, has debunked claims that the Ministry, under his watch, made a $2 million payment to a company in Mauritius as part of the Accra Sky Train project.

He insisted that the money was instead paid by the Ghana Infrastructure Investment Fund.

The Minority in Parliament strongly criticised the government for paying the $2 million to Africa Investor Holdings Limited for the Accra Sky Train Project without parliamentary and the requisite public procurement approvals.

But Mr. Ghartey, in an interview on Eyewitness News on Citi FM on Monday, rejected the claims and said the Minority members were only broadcasting propaganda.

He explained that in projects such as that of the now-defunct sky train project, it was the Ghana Infrastructure Investment Fund (GIIF) that effected such payments, and, therefore, the Minority may want to get the answers it was seeking from the GIIF.

“It is the Ghana Infrastructure Investment Fund that paid the money, and the Fund is mandated to make such payments, and so if the Minority wants anyone to refund the money, they should tell the Auditor General to ask the Fund to refund the money.”

He further emphasised that the South African company that was supposed to execute the project was to come back to Ghana, but the outbreak of COVID-19 prevented that from happening, and that was how his engagement with the South Africans ended on the project, with no payment discussions.

“I went to South Africa in 2018 to make the presentation, because the quality of life is affected by heavy traffic, and then the South Africans came. The company went back and said they wanted a concession agreement of thirty years and I said it was not possible. The company went away and was supposed to come in 2020 and then there was COVID-19.”

“And so as far as my Ministry is concerned, we did not give them any money. I didn’t have any money and I didn’t have the power to pay any money and I did not pay any money. I don’t have the power to write for payment to the company in Mauritius. GIIF [Ghana Infrastructure Investment Fund] is the statutory corporation that has the power to make such payments and so you can ask them.”

The Holy Trinity Cathedral Senior High School (HOTCASS), a once vibrant institution, has been thrust into distress and uncertainty as its nine-classroom one storey building has had parts of its roof ripped off during a rainstorm three years ago, transforming the building into a potential death traps.

The consequences of this devastating event are far-reaching. affecting its students, not only in the immediate aftermath, but also leaving lasting negative effects on their academic, emotional, and psychological well-being

Witnessing and experiencing the potential dangers of an unstable structure has left the students questioning their own safety, creating a sense of fear and uncased that lingers on long after the incident.

The school, which was founded in October 1969 as a private day school by the Anglican Church of the Most Holy Trinity, was later in September 1974 changed into the public curriculum system, making it a fully changed Government Senior High School with a total population of a little over 1,000 students.

The building once stood proudly as an architectural gem, with its soaring roofs and large classrooms, and was a symbol of progress and modernity Gradually, the roof began to weaken, leading to a catastrophic event when it was ripped off, exposes years of neglect in maintaining vital infrastructure.

Inadequate funding and a lack of consistent repairs gradually eroded the roofs durability, exposing the pupils to extreme weather conditions.

Mr. Hubert Essien, the new Headmaster who took over in February this year, in an interview with The Chronicle disclosed that, the school had been in this condition even before he took over.

According to him, the ripped off roof of the three rooms at the top was affecting the whole building, but student still sat there to study because of inadequate classrooms, with the foundation growing weaker and weaker.

He contended that the school had submitted several request for maintenance to the Ghana Education Service since last year, but to avail.

Mr Essien contented that the Member of Parliament (MP) for the Odododiodio Constituency, Nii Lantey Vanderpuje, had been briefed about the situations, yet nothing had been done about it.

The IT Coordinator of the school, Esther Akwah, also revealed that any time it rained heavily the students do not come to school, because they cannot study in the classrooms. At the end of the day, these same students sit with others to write exams.

“Some of the classrooms lack lights and fans, when it’s hot the students sit outside to learn, and when the classrooms are dark the teachers are forced to also move the students out or end the class.” she added

Some of the students who spoke to The Chronicle also noted that it made them uncomfortable and scared, because whenever it rained they were not able to study, which affected their: academic performance. It is for this reason that they are appealing to the government and stakeholders to come to their aid
