Landowners and residents at Central City at Dawhenya in the Ningo-Prampram District have petitioned the Tema Regional Police Command to go rein in persons they suspect to be land guards, but dressed in what appears to be police and military uniforms, who are constantly harassing them.
The petition by the land owners and Numo Mensah Nyavor, representing the Arden Darpoh Family of Dawhenya, follows an interlocutory injunction the Tema High Court granted them, ordering a private developer, Ronidany Company Limited, as the defendant, not to enter their property.
The suit, number LC/190/2022, reads in part: “It is hereby ordered that the defendant/respondent, its agents, assigns, privies or any persons claiming through or under it from alienating be restrained from developing, entering, interfering with or in any way dealing with the property, the subject of the instant suit, until the final determination of this suit.”
The court, presided over by Justice Daniel Mensah, granted the relief upon hearing the submissions of Ekua Eguaken, Counsel for and on behalf of the plaintiffs/applicants.
Elated by the court order, over 500 of the property owners at Central City, led by their General Secretary, Tommie Abu, during the weekend marched to their site to paste the court order on buildings to inform the private developer to respect the court.
On behalf of her clients, the Counsel had, furthermore, officially served a written request to the Tema Regional Police Command for its assistance in ensuring peace, and to help avert any dire situation on the land and its present occupants.
Part of the request read: “This case…suit no. LC 190/2022… is pending at the High Court, Tema, where an interlocutory injunction has been granted in favour of the plaintiffs.
“The plaintiffs have a civil action against the defendant, in which, as part of their reliefs, are seeking an order to set aside on grounds of fraud, a default judgement obtained by the defendant, which granted him possession of a tract of land covering an approximate area of 1995.93 acres.
“The interlocutory injunction granted by the Tema High Court is to restrain the defendant, its assigns, agents and privies claiming through or under it from alienating, developing, entering, interfering with or in any way, dealing with the land, the subject matter of the suit until the final determination of the suit.”
The notice was copied to the Inspector General of Police, the Legal Directorate of the Ghana Police Service and the Legal Directorate of the Ghana Armed Forces, Burma Camp.
