Feature: Alan and Withdrawals: Twice-In-Sixteen

It is exactly sixteen years ago this year, in December 2007, that Hon John Alan Kwadwo Kyerematen, withdrew from the run-off between him and H.E. Nana Akufo-Addo which was to decide who should be flag bearer of the New Patriotic Party in 2008. Sixteen years on, in 2023, Alan Kyerematen has again withdrawn from a presidential primary.

In both cases, he indicated the need for peace and togetherness in the party. And in both cases, he let a lot of people down.

On August 26, 2023 the NPP went into the first stage of electing a flag bearer. This one was the responsibility of selected elites of the party, the Super Delegates, to prune down the aspirants to five, and present their choices to the highest decision-making body of the party, the National Delegates Congress, to decide who is to be the flag bearer.

As expected, Dr. Bawumia, the vice-president, won by landslide and the favourite of the masses, Alan Kyerematen came third after the dynamic Kennedy Agyepong.

The elections conducted by the elites were reduced to an event of crude acts, where rules were abused with impudence. If elites could grossly violate electoral rules and human rights, then what should be expected of the grass roots? Reports had it that in the North East region, an Alan polling agent, Ali Zakaria, had his eye almost plugged out after receiving severe beatings for insisting that right things should be done. Then, Kennedy Agyepong went into his elements after he received news that his agents were also attacked and manhandled in the same region.

For a party who rode on the back of respect for electoral laws, after recording crude events of November, 1992 in a book called The Stolen Verdict, and had the rules of the game of national elections amended, to be seen committing worse electoral crimes, is absurd and very unbelievable. Can the NPP of today have the moral rights to attack the Electoral Commission and the NDC for violation of electoral laws in any general elections?

In 2013, the NPP contested the 2012 elections in the Supreme Court and proved beyond reasonable doubt that there were many forms of electoral malpractices which denied the will of the people. Now, here is where the party has gotten to.

Even though everybody knew Bawumia would win the Super Delegates, did the conduct of the elections promote fair play? Why was that in one center the election was held indoors, instead of outdoors? Why were people intimidated with one on record as almost been lynched? Were these not things that the NPP stood up against and led to the transformation of elections in this country?

If such things continue, and the fact that the elite are not listening to the opinion of the grass root, many might leave the NPP to either join other parties or form their own. Today, the elite want to make the grass root their personal property and would pay them to do menial jobs for them as in voting for their choice. How the grass root feel, what they eat, where they sleep, is none of concerns to the elite. All required of them is to vote for those they have asked to vote for. And this can spell doom for the UP Tradition.

Let the NPP be mindful of the fact that the UGCC was poised to be the first political party to form government in this republic. But, elitism, which made the gurus feel more important than the commoners, made the youth dragged Nkrumah, who always associated with them, out from the UGCC to form the CPP.

In the 1951 Elections, the UGCC picked Omanhene of Assin Atandasu, Nana Sir Tsibu Darku IX, as its candidate for one of the two Sekondi-Takoradi seats. He was a Knight of the Order of the British Empire, Leader of the Joint Provincial Council and Senior African Member of the Burns Constitution, while the CPP picked a common railway engineer, as in, train driver, Alfred Pobee Biney as its candidate. He was a grassroots man, loved by most of the people, while the former, only appealed to the elite. At the end of the day, Alfred Pobee Biney had 51 votes and Nana Sir Tsibu Darku IX had only 13 votes.

Because of elitism, in less than five years, the UGCC disbanded while the CPP, who endeared to the massed shot into the space. Elitism must not be allowed in the NPP.

No true UP Traditionalist will want to see the NPP break-up. And so, it is about time mutual love, respect, rule of law and equal justice are made manifest in the party.

One may not understand why Alan Kyerematen rushed into deciding to withdraw from the primaries, at a time when the grass root wanted to use him to prove to the elite that they also need to be respected. A lot of people are highly disappointed with his decision and some are in tears, up to this day. So, what becomes of the prominent chiefs and religious leaders who openly threw support for Alan? We are here talking about the prophets of the land who told us that God had decreed that Alan would be president in 2025. Were they truly telling us what God said? Will Alan be sworn-in as president in January 2025? If it is indeed the will of God, then so shall it, we are only human; but “how,” will remain the question.

Since its formation in 1957, the United Party (UP) had been on rugged journey. Because of its principle of rule of law and equal justice, the CPP and other socialists do not want it to survive. In 1964, after the amendment of what was left of the 1956 Constitution, Ghana became a one-party state with the CPP as the only official party and the UP was proscribed.

After the 1966 coup, the military leaders decided to return the country to civilian rule in 1969. The UP came together to form the Progress Party which won the general elections. This government was overthrown in 1972 and after seven years, the country was ready to return to civilian rule.

The Progress Party members, under the UP Tradition, decided to form a party. It became the Popular Front Party (PFP), after one of the PP gurus, William Ofori-Atta defected to form his own party, the UNC, and effectively eroded the chances of the Uppist and Victor Owusu, leading the country.

The winning party, the PNC, in 1981, was also overthrown by a military coup, led by Jerry John Rawlings. After eleven years as head of state, Rawlings succumbed to pressure to return the country to civilian rule.

Before the ban on politic parties was lifted on May 18, 1992, Victor Owusu of the UP Tradition came up with a club, called the All People’s Party but it did not catch on well. This was where Kwaku Attakora Mensah Gyimah came into the scene with the Danquah-Busia Club which was launched in Kumasi in 1991. This Danquah-Busia Club converted to the New Patriotic Party on July 28, 1992.

The ambition of the socialists to breakdown the UP Tradition was manifested during the Rawling’s administrations, when pro-Akan businesses perceived to be owned by Uppists, were attacked, confiscated and brought to the ground. Appiah-Menka and Safo-Adu suffered greatly for the crime of only struggling to make Ghana an industrial hub in Africa.

In the first elections of November 1992, everything went wrong at the polls. Pure rigging, in the form of intimidation, beating up of people who stood up for justice, stuffing of ballot boxes and multiple voting were among the methods adopted to make sure that Rawlings won the elections. The losing NPP, stood up to be counted and compelled the EC to start using transparent ballot boxes and also start voting in the opening among others. NPP was the political party who championed reforms in our electoral process and so, to see infarctions the party stood against to be committed in its internal elections, is unbelievable and shocking, to say the least.

By this way, if care is not taken, the party could split and the socialists would praise and thank God for answered prayers. Because why should people be lured, coerced, forced, blackmailed and traumatised into voting against their conscience? Afari-Gyan made it known that once a ballot enters the ballot box, it would be counted. So, evil persons would come out to make sure the ‘wrong’ ballots entered the ballot box in their favour. Wrong because, that was not what the voter would have voted for and wrong because it has been smuggled into the box and also wrong because the person who voted was not illegible to vote.

Some of electoral frauds NPP fought against was about ineligible voters, the under-aged, the non-citizens and those who did multiple registration. Charlotte Osei accused one of her deputies of uploading the voters’ register in his office, when registration had long been closed. Today in NPP, some constituencies are complaining that their albums (internal voters’ register) have been tampered with.

Eligible names are alleged to have been deleted and replaced with people who are not delegates. If this is true and with allegations that the top hierarchy of party has a preferred candidate, aggrieved members of the NPP will not vote for the party’s flag bearer in the 2024 General Elections. When that happens, it will drag the party into a long rough period in opposition.

John Alan Kwadwo Kyerematen’s withdrawal from the primaries should put the whole party into deep reflection of issues in the NPP today. Many are those who have decided to mock him. This will not help. His withdrawal must rather make the whole party forge towards unity and love for one another, so that whoever finally gets the nod will be supported by the entire rank and file of the party. Without that, the NPP should forget 2024.

Let it not be said that the election was screwed in favour of one person who is the choice of the elite, because seriously, if such a thing happens, it will tarnish the image of the flag bearer, going on to campaign to be president. He may be the most qualified one but with that sack of rocks wrongfully put on his innocent back, he would be rejected both internally and externally.

Twice in sixteen years, Alan had withdrawn from primaries. In both cases, he did so, out of sacrifice for the right things to be done. It is now left with the party’s executives and gurus, to offer his withdrawal in supplication to God, with humility, self-denial and contrite hearts, and surely the NPP will reap great blessings.

Afcon qualifiers 2023: Mozambique, Mauritania and DR Congo qualify as Aubameyang’s Gabon miss out

Three more countries sealed their places at the 2023 Africa Cup of Nations (Afcon) on Saturday as Mozambique secured qualification with a dramatic 95th-minute winner.

Mauritania and the Democratic Republic of Congo also booked a spot at next year’s finals, but there was disappointment for striker Pierre-Emerick Aubameyang as his Gabon side missed out.

Three places are still to be resolved for Afcon which kicks off in Ivory Coast on 13 January. Mozambique ensured their return to the Africa Cup of Nations for the first time since 2010 thanks to a late 3-2 win over Benin in Maputo in Group L.

The Mambas knew a draw would be enough against a Benin side who needed a victory to qualify.

Benin started the better, taking a 1-0 lead after 20 minutes thanks to a Steve Mounie penalty.

The hosts quickly fought back with goals from Witi and Ricardo Guimaraes to go 2-1 up, but Benin made it a nervous end for the home fans, finding an equaliser through Jodel Dossou.

As the visitors searched for a winner, Mozambique made sure of their place thanks to the decisive strike in injury-time from Clesio Bauque – a goal which saw Mozambique join holders Senegal as qualifiers from Group L.

Aubameyang’s Gabon miss out

All four nations in Group I went in to Saturday’s games with a chance of qualifying.

But it was the Democratic Republic of Congo and Mauritania who made it through at the expense of Sudan and Gabon respectively.

Mauritania’s home game against Aubameyang’s Gabon in Nouakchott proved a tempestuous affair with red cards for both teams.

Gabon had to play most of the game with 10 men after goalkeeper Jean Noel Amonome was sent off for violent conduct in only the fifth minute.

Mozambique’s goalscoring hero Clesio Bauque

Goals from Hemeya Tanjy and Aboubakar Kamara gave the hosts a comfortable 2-0 lead until Mauritania’s El Hassan Houbeib was dismissed for two yellow cards late in the match.

Didier Ndong clawed one back for Gabon in the 91st minute but the home team held on to seal their place in Ivory Coast and deny Aubameyang – who only returned to the Gabon set-up in May at the request of now-deposed president Ali Bongo.

DR Congo topped Group I thanks to a 2-0 win over Sudan in Kinshasa. Theo Bongonda scored after eight minutes with Fiston Mayele adding a second late on.

Saturday’s games were overshadowed by the earthquake in Morocco that killed more than 1,000 people.

It led to the postponement of Group K’s dead rubber encounter between Morocco and Liberia.

Sunday’s decisive Group G game between The Gambia and Congo-Brazzaville in Marrakech will go ahead.

Saturday’s three qualifiers join Algeria, Burkina Faso, Cape Verde, Egypt, Equatorial Guinea, Guinea, Guinea Bissau, Mali, Mozambique, Morocco, Nigeria, Senegal, South Africa, Tunisia and Zambia at the finals alongside Ivory Coast, who qualified automatically as hosts.

The Elephants ended their Group H campaign with a 1-0 home win over Lesotho – Ibrahim Sangare of Nottingham Forest scoring from a Sebastien Haller assist.

More crucial games will take place up until 12 September as three final nations, including Cameroon, look to secure their place at the 24-team tournament – with a total of 21 teams now already through.

Brazil’s Neymar overtakes Pele goals record in win over Bolivia

Neymar has surpassed Pele as Brazil’s male all-time top scorer with two goals in a 5-1 win over Bolivia.

The forward, 31, who went into the World Cup qualifying match tied with legend Pele on 77 goals, missed a penalty before scoring twice in the second half on his 125th appearance.

“I never imagined reaching this record. I’m no better than Pele or any other player for the national team,” he said.

Marta has scored a record 122 goals in 189 matches for Brazil’s women’s team.

Pele, who died in December aged 82, scored 77 goals in 92 appearances between 1957 and 1971. He was widely regarded to be one of the greatest footballers to ever play the game.

His official account on social media platform X paid tribute to Neymar’s achievement.

“Congratulations Neymar for surpassing the King in goals for Brazil. Surely Pele is applauding you today!” it said.

Brazil coach Fernando Diniz said: “He came to do what he did: have fun, score two goals and break the record.”

Neymar became the world’s most expensive player when he joined Paris St-Germain from Barcelona for £200m in 2017.

He left the French side in the summer to join Saudi Pro League team Al-Hilal.

“He is a very big idol, people must recognise him and accept him,” Diniz added.

Germany sack coach Hansi Flick after poor run of results

Hansi Flick has been sacked as Germany manager following Saturday’s 4-1 friendly defeat by Japan in Wolfsburg. He becomes the first Germany boss to be sacked since the role was created in 1926.

Germany have lost four of their past five games, with Flick overseeing just 12 wins in his 25 matches since replacing Joachim Low in August 2021.

Rudi Voller, who managed the team from 2000 to 2004, takes temporary charge for Tuesday’s friendly with France.

The 63-year-old Voller, a former Germany striker, was appointed director of the German national side in February.

He will be assisted by Hannes Wolf and Sandro Wagner.

Germany host the men’s European Championship next year but have been in disarray.

German FA president Bernd Neuendorf said: “The committee agreed that the German national team needs a fresh impetus after the recent disappointing results.

“Going into the European Championship next summer, we need confidence and optimism in the country regarding our team.

“This has been one of the most difficult decisions I have had to make during my time in this role because I really respect Hansi Flick and his assistants, both on a professional and personal level.

“Sporting success is of the upmost importance to the DFB, which is why this decision had to be made.”

After the Japan defeat, Flick said he was “brutally disappointed” but thought he remained the “right manager” for Germany.

However he ominously added: “Things can change in professional football and I can’t see what’s to come.”

The German FA said it hoped to announce Flick’s full-time replacement “as soon as possible”.

COP Mensah Faces The Sanhedrin

The three senior police officers involved in the ‘IGP tape’ saga are to face a special adjudicating panel to investigate their conducts according to the service regulations.

They are Commissioner of Police (COP) Mr George Alex Mensah, Superintendent Emmanuel Eric Gyebi and Superintendent George Lysander Asare.
A deep throat source at the Police Headquarters intimated to The Chronicle that the said adjudicating panel would be constituted to start sitting to precede the expiry of the terminal leave prior to retirement of COP Alex Mensah.
Mr Mensah was born on August 17, 1963 and enlisted into the Ghana Police Service on 1st January, 1992 and became Commissioner on April 1, 2019.

The COP is billed to end his career as a police officer on September 16, 2023 after 31 years of service.
Meanwhile, the police administration has in a letter dated September 7, 2023 interdicted the three officers in connection with the audio tape, which has become a subject matter of investigation by parliament.
According to the letter, signed by Assistant Commissioner of Police (ACP) Grace Ansah-Akrofi, the interdiction is to make way for disciplinary proceedings into their conducts, in line with police service regulations.
A wireless message to that effect, emanating from the Director General, Administration, has been dispatched to COP, Mr Alex Mensah.

It directs the Commissioner to immediately handover his weapon, uniforms and other police accoutrements, including the service badge and command vehicle to the appropriate schedule officers respectively.
The last time that a Commissioner of Police (COP) was interdicted was on March 6, 2015 when the Director General of Human Resource, COP Patrick Timbilla suffered that fate.
In a related development, Security Analyst, Col Festus Aboagye (rtd) has intimated that the trend of permitting petitions from service personnel by the Parliamentary committee may open the floodgates for frivolous matters. When allowed, it will go a long way to derail the purpose for which the committee was set-up.
He entreated the Honourable persons to remain focused, lest it becomes like the Charlotte Osei matter at the Electoral Commission.

Court to rule on Mosquito’s bail application

The Accra Circuit Court will deliver the ruling on an application for bail variation filed for the first accused (A1), Mawuli Heletsi aka Mosquito, in Lawyer Hamida Nuhu’s case.

Mosquito was initially slapped with GH¢1 million with three sureties, two to be justified, and one should be an ordinary citizen, on July 4, 2023.

The amount was reduced to GH¢500,000.00, after A1 first applied for a bail variation on July 12.

However, Mosquito had since not been able to execute the bail bond, hence, the second application for variation.

The application was made this week Wednesday at the court, presided over by His Honour Samuel Bright Acquah.

Mr. Acquah has set Tuesday September 19, to deliver the ruling on the application.

The other accused persons are David Kokvina (A2); Joseph Nii Amu Offei, alias Gaza, aka Hero (A3); Richmond Tetteh, alias Metiti (A4), Malik Alhassan, alias Goliath @ Ababe (A5); Dennis Adu Ninson, alias NAM1 (A6); Mustapha Mumuni, alias Starboy (A7), and Zuberu Mustapha, alias One Corner (A8).

Offence

They have pleaded not guilty to conspiracy to commit a crime, robbery, and dishonestly receiving.

The applicant, together with seven others, are standing trial for allegedly robbing Lawyer Hamida Nuhu off US$114, 500.00; £800.00; GH¢50,000.00 and €3,000.00.

At gun point, the accused persons further took away another GH¢2,000.00; US$800.00 as well as unquantified number of jewelleries from the lawyer.

The monies were allegedly taken from the lawyer’s trunk inside her closet at her Premier Place home, Airport Residential Area in Accra.

The accused persons are between the ages of 20 and 42 years, with Richmond being the youngest and Mustapha the oldest.

Bail

Mustapha and Zuberu were granted bail in the sum of GH¢100,000 each with two sureties, one of whom should be an income earner and the other ordinary citizen.

Joseph, Richard and Malik were also admitted to bail in the sum of GH¢1 million each, with three sureties to be justified, and one should be an ordinary citizen.

Dennis, on the other hand, was admitted to bail in the sum of GH¢800,000.00 with three sureties, one to be justified, while the other should be an ordinary citizens.

Facts

The case, which was presented by Superintendent Augustine Yirenkyi, was that all of the accused persons are residents of Maamobi, Shukura, Santa Maria, Kokomba Market and Adabraka-Sahara respectively.

Mawuli, David, Joseph and Richmond allegedly attacked and robbed the complainant, Lawyer Hamida Nuhu, on March 26, 2023 at about 2:04am with the other accomplices surrounding the house.

Mawuli, who was dressed in all black and in a mask, armed with pistol, entered the room of the complainant, attacked and robbed her off USS$114, 500.00; GH¢50,000.00; £800 and €3,000, which were in a trunk in her closet.

The prosecutor said Mawuli also took away another GH¢2,000.00, US$800.00 and an unspecified amounts of other foreign currencies, including jewelleries.

He said after A1 finished robbing the complainant, he instructed her to remain in the room else she would be killed.

After the incident, Lawyer Hamida Nuhu lodged a complaint with the police and intelligence led to the arrest of Joseph, who was captured by a CCTV camera arriving at the scene on a motorbike. The CCTV camera also captured the entry and exit of Mawuli from the complainant’s residence.

Richard, on the other hand, was arrested after displaying his share of the booty at Gaza Spot. He disclosed to the police investigation team that David was the one who gave him one of the rings they took from the complainant as his share, but Mawuli collected it from him with force.

Malik was also arrested and pointed out that he gave his share of the spoils to Mustapha and Zuberu.

Malik and Dennis, after their arrest, admitted giving Mustapha GH¢2,000.00 from Malik’s share of the March 27, 2023 robbery.

Although Zuberu admitted having received a laptop from Malik, the latter, however, insisted that he gave him US$500.00, and added that before they went for the robbery, Mustapha and Zuberu gave him cocaine to boost him for the operation.

Dennis has denied the offence and stated that it was Mawuli and David who committed the act.

Supt Yirinkyi added that further investigations revealed that Mawuli and David, after the robbery, ran to Dambai in the Oti Region to consult their spiritual father, who is now a witness in the case, to protect them spiritually from arrest and unnatural death.

The prosecutor said efforts were being made to apprehend the other accomplices, as the case is still under investigation.

Boy, 21 allegedly severs head of nephew in Ada

Tragedy struck the Ada West District in the Greater Accra Region on Wednesday, this week, when a three-year-old boy was found dead in cold blood.

The identity of the little boy is being withheld, but sources say he was brutally murdered by his own uncle, 21-year-old Obed Kabutey, a welder apprentice.
According to reports, Kabutey had gone to his mother’s house at around 7 pm to grab a bite to eat.

Later, he left with his own second younger sister’s son to buy some Indomie noodles. This innocent act of taking his nephew out would later turn into a devastating and tragic incident that would leave the entire community in shock.
After a few hours had passed, the parents of the little boy were worried and went out in search of their child and Kabutey.

Upon questioning, it was revealed that Kabutey had allegedly severed the head of the little boy and left the deceased in the kitchen of his father’s house.
Madam Emelia Agbi, who was the mother of the suspect and the grandmother of the deceased, was understandably distraught and in tears when she heard the news.

The Ada West District Police office was called and they took the body of the deceased to Aness Mortuary at Anyaman, in the Ada West District.
The incident has left the entire community in shock and disbelief. Investigations are ongoing to determine the motive behind this gruesome and senseless act.

Meanwhile, the family of the little boy is devastated and mourning the loss of their precious child.

Yamin cautions NDC youth organisers against complacency

Mr Joseph Yamin, the National Organiser for the opposition National Democratic Congress (NDC) has cautioned the party against complacency towards the 2024 general elections.

According to him, despite the abysmal performance of the governing New Patriotic Party (NPP) in the last six and half years, complacency could cause the NDC in realizing the dream of forming the next government come 2024.

He noted that, the NDC is the only option to salvage the mess created by the government.

Speaking at an orientation and capacity building for the branch youth organisers, under the auspices of the Ashanti regional youth wing in the Sekyere Afram Plans constituency, Yamin reminded the NDC to beware of the governing New Patriotic Party (NPP) and always remain vigilant and united.

The NDC National Organiser expressed the need for the rank and file to focus on a massive campaign to enable them canvas for massive votes to ensure a resounding victory for both the presidential and parliamentary elections in the upcoming 2024 elections.

He is of the view that a massive win for the NDC will bring them back to government, irrespective of the machinations of the Electoral Commission (EC) and the NPP government, which is bent on clinching onto power to continue looting the country’s resources at the expense of the Ghanaian citizenry.

Nana Akwasi Augustus Andrews, the Ashanti regional chairman of the NDC, stressed that the Sekyere Afram Plans is the stronghold of the NDC and they only need to consolidate the unity between the former and current constituency and branch Executives.

He reiterated that the NDC is winning the 2024 elections but stressed that victory would not come on a silver platter, if they do not remain united and embark on a vigorous campaign as a united force.

The Regional chairman stressed that NDC would definitely increase their votes in the Ashanti region and ensure that the victory is achieved in 2024.

CSOs laud implementation of Cylinder Recirculation Model

Civil society organisations have welcomed the implementation of the cylinder recirculation model (CRM) being spearhead by the National Petroleum Authority (NPA).

The Executive Secretary of the Chamber of Petroleum Consumers (COPEC), Mr. Duncan Amoah, and the Executive Director of the Institute for Energy Security (IEA), Nana Amoasi, said the NPA and its partners had done a lot of work to see to the seamless execution of the programme.

They were speaking in separate interviews after site visits to a cylinder bottling plant at Tema and a cylinder manufacturing company at the North Industrial Area in Accra on Wednesday.

The NPA announced the commencement of the implementation of the CRM from September, this year.

Under the model, residents of Accra and Kumasi will exchange empty cylinders for already filled ones at cylinder exchange points. The customer will have to register with their national identification cards or any other form of identification.

The policy is expected to increase uptake of Liquified Petroleum Gas (LPG) from the current 29 percent to at least 50 per cent by 2030. It is also expected to improve safety in the distribution value chain.

The CRM has been piloted in some areas in the Eastern, Ashanti and Northern regions. Mr. Amoah said about 94 percent of the infrastructure work had been completed. He said the remaining six percent was about closing the loose ends, and ensuring additional safety standards.

“Quite a lot of work has been done. The Authority has not gone to sleep.

“All said and done I believe that the facility will go on well looking at the structure in place”, he stressed.

For his part, Nana Amoasi VII said given that most of the bottling pants were ready, the CRM was good to go.He said the Goil bottling plant was in a good position to start operation.

Nana Amoasi VII, however, observed that the bottling area was in the right shape, but noted that the conveyor belt was made up of metal instead of rubber.

He urged the company to speed up the test run of the facility to ensure smooth operations.

In her submission during an engagement with market traders in Accra, the President of the Greater Accra Market Traders, Ms. Mercy Naa Afrowa Nii Djan, described the CRM as a superb programme that would ensure safety in the distribution chain and also avoid cheating.

Besides, she said, the CRM was expected to create more jobs for the teeming youth in the distribution chain.

Gas Sales Agreement between GNPC & Genser Energy must be reviewed -Kwadwo Nsafoah Poku

The Executive Secretary of the Institute for Energy policies and research, Kojo Nsafoah Poku, says his outfit has researched and reviewed the laws and policies governing the mid-stream licensing and operations to ascertain if the agreement signed by Genser Energy and Ghana National Petroleum Corporation (GNPC) conforms to standards.

The following is a full statement issued by the institute explaining its position of the matter.

The Institute has researched and reviewed the laws and policies governing the mid-stream licensing and operations to ascertain if the agreement signed by Genser Energy and GNPC conforms to these standards. In recent months, there have been claims by IMANI and ACEP that, Genser will receive $1.5 billion in gas discounts over a sixteen-year period and the parliamentary select committee on mines and energy has also issued a report in defence of this agreement. There are operational and licensing problems with the agreement which makes it illegal under the current gas polices.

GNPC as the national oil company is not clothed with any laws to participate in the mid-stream. Ghana National Gas Company (GNGC) is the only company licensed by Energy Commission to be the Gas Transmission Utility Company. They are responsible under their license, to build and operate all gas transmission networks across the country. There is an access code developed by Energy Commission which allows 3rd party to build distribution networks to connect the transmission pipelines. The 3rd party can own the gas pipeline but only GNGC can operate the pipeline or GNGC can grant an operator agreement to the 3rd party.  This situation is similar to what pertains in the power sector where Gridco is the only company that can build and operate power transmission networks across the country. Under the Gas Sales Agreement (GSA) signed by GNPC and Genser, Genser is to build and operate a 110 km transmission natural gas pipeline from Dawusaso to Anwomaso near Kumasi.

Under the current law, Genser cannot operate a transmission line. We have sighted a letter from Genser dated 25th July 2023, proposing to split the GSA signed with GNPC into two separate agreements, a standard gas sales agreement and a gas transportation agreement. These new proposed agreements cannot be signed with GNPC because from September 2021, GNPC role as the gas aggregator has been transferred to GNGC under the new government gas policy.

Ghana National Petroleum Company (GNPC) is not in the position to amend or discount the Weighted Average Cost of Gas (WACoG). This computation is done by Public Utilities Regulatory Commission (PURC) considering various factors and cost in the mid-stream.

The law mandates GNGC who is the gas transmission utility company to make a submission to PURC for a review of the WACoG. It is illegal for GNPC to enter into any agreement and discount the WACoG when they are not clothed with any law to do so.

Genser as a private company is free to invest in gas infrastructure but they must do so within the existing legal framework of the country. The only revenue available to the Utility company GNGC, is the transmission charge of US$0.625/mmBTU. This is the money they rely on for all their operations and investments. If Genser cannot recover their cost through the transmission charge, then they should revise their business model.

In the power sector, the government will not allow the IPP Asogli to contract a private company to build power transmission lines to another city without the involvement of Gridco. So why are we prepared to overlook the role of GNGC, who is the only transmission utility company licensed under law to perform this function. Genser has built the 110 km pipeline, under what license will they operate this transmission line?

Our recommendations are as follows:

  1. The existing Gas Sales agreement should be split into two as proposed by Genser. The standard gas sales agreement should be signed with GNGC as the gas aggregator without any discount to the WAGoG.
  2. The transportation agreement should be signed with GNGC as the gas transmission utility company. In that agreement, the issue of capital cost recovery for the 110 km pipeline and operatorship will be addressed.
  3. PURC and Energy Commission should be made to mediate all the technical and financial details arising from this agreement.

All the gas agreements signed by GNPC are to be novated to GNGC as the new gas aggregator, so it is only appropriate that the current GSA is abrogated and replaced by the two new agreements. Instepr is hopeful that the necessary steps will be taken to correct this anomaly and restore confidence in the country’s mid-stream activities.
