The Accra High Court has granted bail totalling GH¢150 million to the embattled former Chief Executive Officer of the National Food Buffer Stock Company (NAFCO), Hanan Abdul-Wahab, and his wife, Faiza Seidu Wuni, who are standing trial for alleged financial crimes.
The couple, who have pleaded not guilty, were admitted to bail after lawyers for both the Republic and the defence made extensive legal submissions on Thursday.
Deputy Attorney-General, Dr. Justice Srem-Sai, appeared for the Republic, while former Deputy Attorney-General, Joseph Dindiok Kpemka, represented the accused persons.
Submissions
Moving the application, Mr. Kpemka urged the Court to grant the accused bail, stressing that they were family persons with young children and had fully cooperated with investigative bodies since their arrest.
“They have never on one occasion failed to avail themselves to EOCO. When bail was granted at EOCO, they faithfully complied with the conditions,” he said.
“The Constitution presumes them innocent until proven guilty. The conditions for bail should not amount to a denial.”
He described as unfortunate the discovery that some sureties earlier presented forged documents to secure police enquiry bail, insisting the accused could not have verified the authenticity of the said documents while in custody.
Prosecution’s Response
Dr. Srem-Sai told the court the state did not oppose bail but urged the judge to take into account the gravity of the alleged offences and the amount involved.
“This is a white-collar crime involving in excess of GH¢150 million. The accused is a man of substantial means living in a prime area in Accra; there is a likelihood of evading trial,” he stated.
He also cited concerns arising from alleged forged documents used to secure earlier police bail, arguing it raised questions about the accused’s readiness to face trial.
Court Decision
After hearing the parties, the presiding judge Justice Audrey Kocuvie-Tay granted the following bail terms:
Hanan Abdul-Wahab (A1) — GH¢100 million with six sureties, four to be justified
Must deposit all passports
Sureties to provide ID, digital address and update any change of address with the registrar
Faiza Seidu Wuni (A2) — GH¢50 million with four sureties, three to be justified
Must deposit all passports and be placed on a stop-list
Sureties to deposit Ghana Cards at the registry
The court also granted bail for the 4th and 5th accused persons on similar terms as A1.
The judge ordered the prosecution to file disclosures by November 27, 2025, and adjourned the case to the same date at 9:00 a.m.
Background
Investigations into the case have revealed that documents previously used by sureties to secure police enquiry bail were allegedly forged — a matter now adding to scrutiny of the accused persons’ actions.
The case is part of ongoing efforts to prosecute alleged financial breaches at NAFCO.
