Child Custody Dispute: Court Orders Arrest Of Baaba Sam

The Achimota District Court has issued a warrant for the arrest of Karen Baaba Sam for the unlawful custody of her four-and-a-half-year-old daughter.

Following this, the police have declared her wanted and are pursuing all avenues to apprehend her.

This declaration stems from a bench warrant issued for her arrest to assist the Criminal Investigation Department (CID) with investigations into allegations of unlawful child removal.

Ms. Sam, 29, a native of Dormaa in the Bono Region, has been involved in a protracted custody dispute with the child’s father.

Despite a previous order by the Family Tribunal granting custody of the child to the father, she has allegedly refused to comply.

Subsequently, a Juvenile Court in Accra directed the Commander of the CID Division of the Ghana Police Service to prevent Ms. Sam from traveling out of the country with the child.

The court, presided over by Ms. Bernice Mensimah Ackon, also instructed the Director-General of the Ghana Immigration Service to enforce this restriction.

The dispute traces back to April 2024 when Mr. Kwabena Adjei filed the case at the Juvenile court against Ms. Sam.

They were cohabiting until the birth of their daughter. However, between 2021 and 2022, Mr. Adjei reportedly observed a change in Ms. Sam’s behaviour

In February 2024, while Mr. Adjei was abroad for medical treatment, Ms. Sam reportedly sought his permission to take their child on a trip to a beach resort. He approved and transferred GH¢50,000 to her for the trip.

Upon his return, Mr. Adjei decided to take the child to Big Blue Resort where she identified as a place her mom and another man had once visited.

Although the court has granted the father temporary custody and allowed the mother access to the child, it has yet to make a decision on permanent custody for either parent.

It also ordered the retrieval of the child with the assistance of Social Welfare from the mother.
