The Circuit Court 3 in Accra, presided over by Her Honour Susana Eduful, has issued a bench warrant for the arrest of a 65-year-old Pensioner, David Sackey, after he failed to appear before the court to answer a charge of threatening death.
The warrant was issued upon prayer by Chief Inspector Ebenezer Teye-Okuffo, who told the court that David Sackey had been duly informed of his summons but failed to show up without any lawful excuse.
The court subsequently ordered that the accused be arrested and produced before November 18, 2025.
David Sackey is facing trial on a charge of threat of death, contrary to Section 75 of the Criminal Offences Act, 1960 (Act 29).
Background
According to the brief facts presented to the court, the complainant, Prince Sackey, a housing officer residing at Sempe-Mamprobi, and the accused, David Sackey, who resides at Marnette Estate-Spintex, are biological brothers.
The incident is said to have occurred on December 31, 2020 at their family house at Sempe-Mamprobi.
The prosecution narrates that the accused confronted another brother, Eugene Sackey, over a debt. During the argument, the complainant emerged, prompting the accused to hurl insults at him.
An exchange reportedly ensued, during which the accused allegedly pulled out a pistol. The complainant quickly held the weapon, leading to a struggle. Eugene intervened and calmed the situation.
The complainant later travelled to the United Kingdom that same day and Eugene reported the incident to police the following day.
Prince Sackey returned to Ghana on January 19, 2022 and formally lodged a complaint, leading to the accused’s arrest and caution statement. He was later charged and brought before the court.
With the bench warrant now issued, the police are expected to arrest and present Sackey for the continuation of the case.
